Terms of Use of the HLADINY.CZ Portal

1. Introductory Provisions

1.1. These terms govern the rights and obligations arising from the use of the web portal hladiny.cz (hereinafter referred to as the "Portal").

1.2. The operator and author of the Portal is FIEDLER AMS s.r.o., with its registered office at Lipová 1789/9, České Budějovice 2, 370 05 České Budějovice, Company ID: 03155501 (hereinafter referred to as the "Operator").

1.3. By accessing and using the Portal, each user expresses their agreement to these Terms of Use.

2. Purpose of the Portal and Nature of Data

2.1. The Portal serves as a publicly beneficial service for the general public. It displays aggregated data from telemetry units and sensors (e.g. water level states of watercourses) produced by the Operator, with the consent of the owners of these units.

2.2. The Portal is intended to inform the public (e.g. during floods, for paddlers and tourists).

2.3. All data displayed on the Portal is for informational purposes only. The Operator does not guarantee its absolute accuracy, completeness, or timeliness (connection outages, sensor failures, etc. may occur).

3. Copyright Protection and Database

3.1. The content of the Portal, including its structure, design, texts, and graphics, is protected by copyright.

3.2. The database of measurements and sensor data presented on the Portal is protected under Act No. 121/2000 Coll., the Copyright Act, as amended, as a database maker's right (§ 88 et seq.). The database maker is exclusively the Operator.

4. User Rules and Prohibition of Commercial Use

4.1. Users are entitled to browse the Portal content and use its data exclusively for their personal, non-commercial use.

4.2. It is strictly prohibited:

• To extract or reuse the whole database or its quantitatively or qualitatively substantial parts without prior written consent of the Operator.
• To systematically and repeatedly download insubstantial parts of the database (e.g. using automated scripts, robots, or web scraping).
• To use data from the Portal for commercial purposes, integrate it into own applications, information systems, or third-party presentations, or present it as own data, even if provided free of charge.

4.3. Violation of this prohibition is considered a breach of copyright and may constitute unfair competition. In such case, the Operator is entitled to block access to the user (or a specific IP address) and claim compensation for damages and unjust enrichment.

5. Disclaimer of Liability

5.1. The Operator bears no liability for any direct, indirect, or consequential damages, lost profits, or harm (including property damage due to floods or personal injury) incurred by the user or third parties in connection with the use of data from the Portal or due to outages or unavailability of the Portal.

6. Final Provisions

6.1. These terms are governed by the laws of the Czech Republic.

6.2. The Operator reserves the right to modify these terms at any time. The amended terms become effective upon their publication on the Portal.
